These Terms of Service ("Terms") govern your use of the Chevra Kadisha Mortuary website (the "Site"). By using the Site, you agree to be bound by these Terms.
You agree to use the Site only for lawful purposes and in accordance with these Terms. You must be at least 18 years of age to use this Site or submit information. By using the Site, you represent that you are of legal age to form a binding contract.
You agree not to: attempt to interfere with or disrupt the operation of the Site; use automated tools to scrape, crawl, or harvest data from the Site without our prior written permission; introduce malware, viruses, or other harmful code; or attempt to gain unauthorized access to any part of the Site or its related systems.
When you submit information through our contact forms (e.g., name, phone number, email address), you authorize us to use that information to respond to your inquiry and provide the services you request.

By submitting an inquiry or request through our website forms, you consent to receive electronic communications from us in connection with your inquiry or requested services. This includes email and other electronic correspondence related to the services you have requested.

To the fullest extent permitted by law, Chevra Kadisha Mortuary shall not be liable for any indirect, incidental, or consequential damages resulting from your use of, or inability to use, the Site.
If you wish to make a payment for funeral, cemetery, or related services provided by Chevra Kadisha Mortuary (each such payment, a "Transaction"), you may be asked to supply certain information relevant to your Transaction including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and the name of the deceased for whom services are being arranged.
YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY CREDIT CARD(S) OR OTHER PAYMENT METHOD(S) UTILIZED IN CONNECTION WITH ANY TRANSACTION, AND THAT YOU ARE AUTHORIZED TO MAKE PAYMENT ON BEHALF OF THE ESTATE OR FAMILY OF THE DECEASED.
By submitting such information, you grant Chevra Kadisha Mortuary the right to provide such information to third-party payment processors for purposes of facilitating the completion of Transactions initiated by you or on your behalf. Verification of information may be required prior to the acknowledgment or completion of any Transaction.
Chevra Kadisha Mortuary shall not be liable for any unauthorized use of a payment method in connection with a Transaction. In the event that a Transaction is disputed, charged back, or otherwise reversed due to unauthorized use of a payment method, the responsible party shall remain fully liable for all amounts owed for services rendered. Chevra Kadisha Mortuary reserves the right to pursue all available legal remedies to recover amounts owed in connection with any disputed or reversed Transaction.
Payments by check must include the name of the deceased in the memo field. We accept personal checks and cashier's checks. We reserve the right to require a cashier's check or other guaranteed form of payment at our discretion. All financial arrangements must be completed prior to the rendering of services, unless otherwise agreed upon in writing by an authorized representative of Chevra Kadisha Mortuary.
All funeral and cemetery service arrangements are governed by the written contract executed between Chevra Kadisha Mortuary and the responsible party at the time services are arranged. Cancellation of at-need (immediate) funeral services after removal of the deceased has commenced may be subject to applicable charges for services already rendered.
Pre-need funeral contracts are subject to California law, including the right to cancel within a specified period as disclosed in your pre-need contract. Funds paid under a pre-need contract are held in a California state-regulated trust account in accordance with applicable law. These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of this Site shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you hereby consent to the personal jurisdiction of such courts.
In the event of a dispute arising out of or relating to these Terms or the services provided by Chevra Kadisha Mortuary, the parties agree to first attempt to resolve the dispute informally by contacting our office at (323) 654-8415 or ckmort@gmail.com. If the dispute cannot be resolved informally within thirty (30) days, the parties agree to submit the dispute to final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with arbitration to take place in Los Angeles County, California. The arbitrator's decision shall be final and binding on both parties.
You agree to defend, indemnify, and hold harmless Chevra Kadisha Mortuary, its owners, officers, employees, agents, and representatives from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of and access to this Site; (b) your violation of any provision of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property or privacy right; or (d) any unauthorized use of a payment method submitted through this Site.
Chevra Kadisha Mortuary shall not be liable for any delay or failure to perform its obligations under these Terms to the extent such delay or failure results from causes beyond our reasonable control, including but not limited to natural disasters, governmental actions, utility outages, transportation interruptions, labor disputes, or failures of third-party service providers.
Chevra Kadisha Mortuary reserves the right to modify these Terms of Service at any time at our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of this Site following the posting of revised Terms constitutes your acceptance of the changes. We encourage you to review these Terms periodically.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions of these Terms shall continue in full force and effect.
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Chevra Kadisha Mortuary with respect to your use of this Site and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and Chevra Kadisha Mortuary with respect to this Site.
